THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6175 of 2022 ORDER:

This Criminal Petition is filed under Section 437 & 439 of the Code of Criminal Procedure,' 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/A2 on bail in connection with Crime No.139 of 2022, on the file of Mangalhat Police Station, Gosha Mahal Division, Hyderabad, registered for the offence punishable under Section 8(c) read with 20(b) (ii) (c) of NDPS Act, 1985. 2.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that on 05.05.2022, Accused No.1 was caught in his house with 21 kgs. of ganja by the Mangalhat Police.

Learned Counsel for the petitioner submits that even according to the prosecution, the contraband was in possession of Accused No.1 in his house; and that only for the reason of this petitioner's presence in the said house, this petitioner has been implicated.

However, learned Assistant Public Prosecutor submits that four other cases are pending against this petitioner.

Keeping in view that the contraband was seized in the premises of Accused No.1's house at A1's instance and that Accused Nos.3 to 6 were released on bail, this petitioner can be released on bail subject to the following conditions. i. The petitioner/A2 is directed to be released on bail on his executing personal bond for Rs.50,000/-(Rupees Fifty Thousand only) with two sureties for a like sum each, to the satisfaction of I Additional Metropolitan Sessions Judge, Hyderabad.

ii. On such release, the petitioner/A2 shall appear before the concerned Station House Officer every day at 10.00 a.m. for a period of six weeks, for the purpose of investigation.

iii. The petitioner/A2 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. 7.

Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
