2015-10-19Vilas V.Afzulpurkar1 pages

THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.33368 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies.

The impugned order questioned in this Writ Petition is one cancelling the authorisation of the petitioner. Though the present Writ Petition is filed on various grounds, it is not in dispute that the said order is appealable and no statutory appeal is filed by the petitioner against the said cancellation. Since the petitioner has efficacious alternative remedy, there is no reason to entertain the Writ Petition. However, the petitioner is at liberty to file an appeal along with the stay petition before the appellate authority i..e, the Joint Collector, Ranga Reddy District, the 2nd respondent, and if such an application is preferred, the 2nd respondent shall consider the same and pass appropriate orders at least to the extent of stay petition, at the earliest.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
