HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21595 OF 2010 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents 2 and 3 in interfering with the erection of cell tower in the building situated in Survey No.270/1, 270/2, Somavarappadu Village, Denduluru Mandal, West Godavari District in pursuant to the permission granted by the Gram Panchayat, as illegal and arbitrary.

This Court on 30.08.2010, while admitting the writ petition granted interim stay of the impugned notice dated 28.07.2010 and the same is operating from the year 2010.

Heard learned counsel for the petitioner and respondents. Learned counsel for the petitioner states that the writ petition can be disposed of in terms of the interim order.

Recording the above submission, the writ petition is disposed of directing the respondents not to take any steps for removal of the tower erected by the petitioner, without following due process of law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
