HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12630 of 2003 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not issuing posting orders to the petitioner appointing him as Conductor or Clerk in Cuddapah or anywhere in Andhra Pradesh on compassionate grounds, as illegal and arbitrary.
When the matter is taken up for hearing, learned standing counsel for the respondents has contended that the husband of the petitioner had expired in the year 1983 and thereafter the respondents had paid additional monetary benefit to the petitioner. He has further contended that after lapse of nearly 1 1⁄2 decades the petitioner filed this writ petition seeking appointment on compassionate grounds and the writ petition is not maintainable as the petitioner had already received additional monetary benefit in lieu of compassionate appointment.
In view of the above said submission, this Court is of the considered view that there cannot be a direction to the respondents to consider the case of the petitioner for appointment on compassionate grounds as the petitioner had already received the additional monetary benefit in lieu of compassionate appointment. The writ petition is devoid of merits and the same is liable to be dismissed.
Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
