THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT APPEAL No. 1278 of 2016 JUDGMENT: (Per VRS,J) As against an award of reinstatement with continuity of service and attendant benefits, but without back wages, the Andhra Pradesh State Road Transport Corporation filed a writ petition. Finding that within the limited jurisdiction available under Article 226 over the award of the Labour Court, no interference was called for, the learned Judge dismissed the writ petition. Aggrieved by the said dismissal, the A.P. State Road Transport Corporation is before us. 2.

Heard Mr. N. Vasudeva Reddy, learned standing counsel for the Andhra Pradesh State Road Transport Corporation, appearing for the appellant. Mr. S.A.K. Mynuddin, learned counsel, takes notice for the 1st respondent-employee.

Admittedly, the 1st respondent was placed under suspension on 19.05.1993 and imposed with the penalty of removal from service on 27.01.1994. The Labour Court passed an award in I.D.No.303 of 1999, directing reinstatement without back wages. Accordingly, he was reinstated only in 2009, after a period of 15 years. Therefore, the

VRS,J & GSP,J WA No.1278 of 2016 learned Judge thought fit not to interfere with the grant of continuity of service and attendant benefits. We find no reason to interfere with the order of the learned Judge. Hence, the Writ Appeal is dismissed. Consequently, miscellaneous petitions if any pending in the writ appeal shall stand dismissed.
