THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.2118 of 2015 Order:
This Writ Petition is filed to declare the action of the respondents in granting permission to run the quarry operations i.e., stone crushing units in Survey No.619, situated at Thippayapalli village, Pullampet Mandal, YSR Kadapa district, as illegal and arbitrary.
When the matter is taken up for hearing, learned Assistant Government Pleader has passed on the written instructions, wherein it is stated that the Deputy Director of Mines and Geology, Kadapa, vide proceedings dated 22.03.2007, had granted quarry lease in favour of one C. Sridhar Reddy for road metal and building stone over an extent of 1.000 Hectare in Survey No.619 of Thippayapalli village, Pullampet Mandal, YSR Kadapa district for a period of 10 years and that the lease deed was executed on 21.06.2007. It is further stated that on 25.04.2009 determination proposals were submitted to the Deputy Director of Mines and Geology, Kadapa for non-payment of advance dead rents for the year 2009-2010 and the Deputy Director of Mines and Geology, after issuing show cause notice dated 30.04.2009 to the lessee, issued proceedings dated 10.09.2009 determining the quarry lease. Questioning the said determination of lease, the lessee filed an appeal before the Director of Mines and Geology, Hyderabad, and the said appeal was dismissed on 20.06.2015.
In view of the fact that the lease given in favour of C. Sridhar Reddy was determined and that the appeal filed by the said Sridhar Reddy against the determination of lease was also dismissed, no further orders are necessary in the present Writ Petition. However, at this stage,
learned counsel for the petitioners submits that in spite of the determination of the lease, some persons have dug the borewell and that they would carry on some operations therein.
In view of the submission made by the learned counsel for the petitioners, the Writ Petition is disposed of giving liberty to the petitioners to file fresh representation before the appropriate authority ventilating their grievances, if any.
The Writ Petition is, accordingly disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
