THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.12369 of 2015 ORDER:

1. This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioners who are accused Nos.1 to 4 in C.C.No.202 of 2013 on the file of the Judicial Magistrate of First Class, Special Mobile Court, Guntur. 2 . At the time of arguments, the learned counsel for the petitioners has sought permission of the Court to permit the petitioner to withdraw this Criminal Petition, with a liberty to avail the remedies available to them under law. He further submitted that the presence of the petitioners may be dispensed with before the trial Court on each and every date of adjournment.

3. Permission is granted.

4. There is no dispute with regard to the identity of the petitioners 2 to 4 herein/A-2 to A-4. Even if the presence of the petitioners 2 to 4 herein/A-2 to A-4 is dispensed with, no prejudice will be caused to the first respondent. Therefore, the presence of the petitioners 2 to 4 herein/A-2 to A-4 in C.C.No.202 of 2013 on the file of the Judicial Magistrate of First Class, Special Mobile Court, Guntur, on each and every date of adjournment is hereby dispensed with. However, the petitioners 2 to 4 herein/A-2 to A-4 shall appear before the trial Court as and when their presence is required.

5. With the above observations, the Criminal Petition is dismissed as withdrawn. Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
