HON'BLE SMT. JUSTICE JUVVADI SRIDEVI I.A.No.1 of 2025 in CRIMINAL PETITON No.8919 of 2024 ORDER :

This application is filed seeking to reduce the surety amount from Rs.10,000/- with two sureties to that of Rs.5,000/- with two sureties for petitioner/accused No.4.

Heard Sri Mohammad Imthiyaz Pasha, learned counsel for petitioners and Smt.S.Madhavi, learned Assistant Public Prosecutor for the respondent-State.

This Court, vide order, dated 13.08.2024 in Crl.P.No.8919 of 2024, while granting anticipatory bail directed the petitioners/accused Nos.4, 5 and 8 to surrender before the Station House Officer of P.S. Medipally and on such surrender, the said Station House Officer shall release the petitioners/accused Nos.4, 5 and 8 on bail on each of them executing a personal bond for Rs.10,000/- with two sureties, for the like sum each.

Petitioner/accused No.4 seeks to relax the said condition as stated above.

It is contended by the learned counsel for petitioner that the petitioner is a daily wage earner and belongs to economically

JS, J Crl.PNo.8919 of 2024 weaker section of society, due to which, he is not in a position to furnish two sureties for Rs.10,000/-, as the same is very huge amount for him.

In view of the above and in the facts and circumstances of the case, this Court is of the considered view that it is a fit case to reduce the surety amount.

Accordingly, this application is allowed and the impugned order, dated 13.08.2024 in Crl.P.No.8919 of 2024 is modified to the effect that the petitioner/accused No.4 shall furnish two sureties for Rs.5,000/- and the petitioner/accused No.4 shall surrender before the concerned Station House Officer on or before 10.04.2025. The remaining conditions imposed vide order 13.08.2024 shall remain unaltered.
