HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39204 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking a direction to the respondents not to interfere with their life and liberty.

Heard and perused the material available on record. 3.

It is stated in the affidavit that aggrieved by the action of the police in interfering with the civil disputes, earlier, the 1st petitioner filed WP No.30958 of 2016 before this Court and this Court by order dated 16.9.2016 directed the respondent therein including respondents Nos.1 and 2 herein not to interfere with the life and liberty of the petitioner in any manner except in accordance with law. While so, a false complaint was lodged by the 3rd respondent with false allegations stating that the 1st petitioner got alienated the property in favour of the 2nd petitioner by giving false information and when the 3rd respondent questioned the said issue, the 1st petitioner informed about the pendency of the suit and on 16.10.2016, the petitioners stopped the 3rd respondent and threatened him. On the said complaint, Crime No.100 of 2016 was registered against the petitioners. It is the grievance of the petitioners that they have not committed any offence as alleged.

The petitioners filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, considering the grievance of the petitioners, without expressing any opinion on merits, the official respondents are directed to complete the investigation and file a final report, in accordance with law, without arresting the petitioners. The official respondents are further directed not to compel the petitioners to

settle the civil disputes in the name of investigation. The petitioners are directed to appear before the Station House Officer concerned as and when required and they are also directed to execute a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety each for the like sum each to the satisfaction of the Station House Officer concerned, as surety for their future appearance as and when required. 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 15th November, 2016 Nn
