THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.22160 OF 2019

O R D E R

The petitioner is a construction firm, and it is represented by its Managing Director. The case of the petitioner is that it constructed residential flats in the subject property, with all the statutory permissions, and while the construction was in progress, the respondent - company provided temporary power supply under category VII, which comes under commercial activity, and now that the construction is completed and the occupancy certificates were also provided to the residential flats by municipal corporation, they are entitled for power supply under category VI, which is for domestic use. The grievance of the petitioner is that the respondents are not considering its case for conversion of power supply from category VII to category VI, and they are insisting for a letter from Apartment Association, which is not a statutory requirement. Aggrieved by the action of the respondents in not converting the power supply from category VII to category VI, the present writ petition is filed.

Heard the learned counsel for the petitioner. Sri R.Vinod Reddy, learned Standing Counsel for respondent - company, on instructions submits that the case of the petitioner will be considered in accordance with law for conversion of category as sought for, provided there are no outstanding dues.

Having regard to the facts and circumstances of the case, competent authority of the respondent - company is directed to convert the power supply of the petitioner from category VII to category VI in accordance with law, without insisting for any letter from the apartment association, provided there are no outstanding dues payable by the petitioner.

The writ petition is accordingly disposed of.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
