HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 35482 of 2012 Order:
This writ petition is filed challenging the action of the third respondent in not investigating the case in Crime No.318 of 2012 on the file of Bowenpally Police Station, registered for the offence under Section 304(B) IPC.
2. When the matter is taken up for hearing, learned Government Pleader for Home, on the basis of written instructions, submits that the petitioner had approached the police of Bowenpalli Police Station and lodged a complaint on 25.09.2012 stating that his daughter, who was married to one Ravi Goud, expired while undergoing treatment on 25.09.2012 and he suspects the death of his daughter. He further submits that basing on the said complaint, a case in Crime No.318 of 2012, under Section 174 Cr.P.C, was registered and the matter was taken up for investigation. During the course of investigation, the statements of the petitioner and his wife were recorded and they did not suspect anybody for the death of their daughter. The husband of their deceased daughter was also examined.
The Deputy Tahsildar had conducted inquest over the dead body of the deceased and in the post-mortem report it was opined that the death of the deceased was due to Sepsis due to natural cause (or) consumption of unknown poison may not be ruled out. No ante-mortem or post-mortem injuries were found on the body. He further submits that after completion of investigation, permission was obtained from the Assistant Commissioner of Police, Begumpet Division, to refer the complaint as "Action dropped" and, accordingly, a final report was also filed before the Special Executive Magistrate, Hyderabad on 20.01.2016.
3. In view of the above events, the relief sought for by the petitioner in this Writ Petition cannot be granted and the Writ Petition is,
accordingly, dismissed. However, in the circumstances, no costs.
4. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
