O R D E R
This writ petition was filed by 43 individuals assailing the action of the Mandal Revenue Officer, Saroornagar, Ranga Reddy District, in trying to demolish the houses situated in Sy.No.99/1, Baba Shareefuddin Colony, Pahadi Shareef Village, Saroornagar Mandal, Ranga Reddy District, without following the due process of law.
By order dated 18.05.2004, this Court directed status quo existing as on that day with regard to possession to be maintained. Despite the lapse of over a decade, the respondents have not chosen to file a counter. Voluminous material placed on record by the petitioners indicates that the Gram Panchayat, Pahadi Shareef, issued the petitioners permission for house construction and also collected fees/charges in respect thereof. In the absence of any rebuttal to the petitioners' claim that they are in possession of the subject properties, this Court is compelled to accept the same. That being so, the respondents would be bound to adhere to the procedure laid down by law in the event they wish to take any action.
The writ petition is therefore disposed of directing the respondent authorities to follow the due procedure laid down by law in the event they wish to interfere with the properties situated in Sy.No.99/1, Baba Shareefuddin Colony, Pahadi Shareef Village, Saroornagar Mandal, Ranga Reddy District. Interim order dated 18.05.2004 shall stand vacated in the light of this final order. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
