THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.19028 of 2018 ORDER:

Heard Ms.V.Himabindu holding for Mr.K.Chaitanya, counsel for petitioner and the learned Assistant Government Pleader for respondents Nos. 1 to 5.

In short, the grievance of petitioner is that the respondents are interfering with the possession and enjoyment of petitioner of agricultural land in an extent of Ac.3-19 gts in Sy.No.78/4 of Hussainnagar village, Nyalkal Mandal, Sangareddy District without either fixing the boundaries or following the procedure stipulated by law, as illegal, arbitrary and unconstitutional. The Assistant Government Pleader places on record, the written instructions dated 29.06.2018 received from 3rd respondent.

In view of the admitted fact position, this Court is relieved from referring to the details set out in the writ affidavit. Briefly stated, the 3rd respondent does not dispute the entitlement of petitioner to an extent of Ac.3-19 gts in Sy.No.78/4. According to respondents, they are not interfering with the petitioner's possession of Ac.3-19 gts but delineated unassigned land to an extent of Ac.0-21gts in the same sub-division.

The Assistant Government Pleader submits that the 3rd and 4th respondents would make available for the survey and demarcation of petitioner's land in Sy.No.78/4 measuring Ac.3-19gts and Ac.0-21gts which was allegedly occupied by the

petitioner, within four (04) weeks from the date of receipt of copy of this order and the enjoyment of the property shall be in accordance with the survey and demarcation.

The statement of Assistant Government Pleader that respondents are not interfering with Ac.3-19gts is placed on record.

Writ petition is disposed of accordingly. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
