HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.733 of 2015 ORDER:

This petition is filed to withdraw O.P.No.108 of 2015 from the file of IV Additional District Judge-cum-Family Court, Kurnool and transfer the same to the Courts at Kadiri, Anantapur District.

2. Wife filed this petition. According to her affidavit, her marriage was performed with respondent on 15.02.2013 as per Hindu rites and caste customs and at the time of marriage, respondent is working at Tirupati. She stated that she joined respondent at Kurnool and lived there for about 10 months and due to harassment, she came out from marital home and went to her parents house and she lodged a complaint before Kadiri Police Station, which is registered as Crime No.40 of 2015 under Sections 498 (A), 506 r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act and as a counterblast respondent filed O.P.No.108 of 2015 before Family Court, Kurnool seeking divorce. She stated that she is residing with her parents house at Kadiri in Anantapur District and she is not keeping good health and not in a position to travel from Kaidiri to Kurool along with her minor child by covering a distance of 270 KMs, for these reasons, she prayed for transfer of O.P.No.108 of 2015 from Kurnool to Kadiri.

3. Heard arguments.

4. Advocate for petitioner submitted that as the wife is facing inconvenience, O.P. may be transferred to Kadiri by taking the convenience of wife into consideration.

5. Advocate for respondent submitted that at Kadiri there is

no family Court and respondent has no objection if O.P. is transferred to Family Court of Anantapur District.

6. Considering the submissions of both sides and also considering the affidavit of petitioner filed in support of the petition, O.P.No.108 of 2015 is withdrawn from the file of I V Additional District Judge-cum-Family Court, Kurnool and transferred to Family Court, Anantapur District for disposal in accordance with law.

7. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
