THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.17763 of 2014 in Crl.P.No.1454 of 2014 and Crl.P.No.1454 of 2014 Common Order:
T h e defacto complainant and his counsel Sri Y.Ashok Raj are present. A.1 to A.3 and their counsel Sri T.S.N.Murthy are present.
Heard both sides and perused the petition.
On the report given by defacto complainant, the Police of Nagarampalem P.S, Guntur Urban registered FIR No.531 of 2013 against accused for the offences under Sec.323, 427, 506 r/w 34 IPC and investigation is stated to be pending.
While-so, now the submission of both sides it that at the intervention of elders, the parties have amicably settled their disputes by entering into compromise and therefore, permission may be accorded to compromise and compromise may be recorded and proceedings in F.I.R No.531 of 2013 on the file of Nagarampalem P.S may be quashed in the interest of justice.
Having regard to the above said submission and considering that the matter relates to a family dispute wherein the parties have amicably resolved their disputes and hence no useful purpose will be served even if the
investigation is ordered to be continued and also following the decision reported Gian Singh vs. State of Punjab and another[1], this petition is allowed, permission is accorded and compromise is recorded in terms of the accompanying memorandum of compromise and consequently, the proceedings in FIR No.531 of 2013 on the file of Nagarampalem PS are hereby quashed. In the result, both the petitions are accordingly disposed of.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
