THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9549 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in FIR No.52 of 2016 on the file of Vetapalem Police Station, Prakasam District, registered for the offences punishable under Sections 376, 377 IPC and Section 4 of POCSO Act.

Heard and perused the material available on record. It is alleged that the petitioner called the victim girl, who is aged about six years, and took her into his house and committed penetrative sexual assault on her.

Learned Counsel for the petitioner submitted that there are disputes between the petitioner and the de facto complainant and that the petitioner was falsely implicated in the above crime and he was beaten by the husband of the de facto complainant and that the petitioner was arrested on 29.4.2016 and since then, he has been in prison.

Learned Additional Public Prosecutor submitted that the petitioner committed heinous crime and therefore, it is not a fit case to grant bail.

Considering the facts and circumstances of the case and the gravity of the offence alleged, this Court is not inclined to grant bail to the petitioner.

At this stage, the learned Counsel for the petitioner seeks to grant liberty to move another bail petition after some time. Accordingly, the Criminal Petition is dismissed granting liberty to the petitioner as sought for.
