THE HON'BLE Dr. JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.6149 of 2022 ORDER :

Heard Sri Shankar who is representing Sri Padala Pravin Kumar, learned counsel on record for the petitioners, the learned Additional Public Prosecutor, who is representing respondent No.1 as well as Smt.

K.Mahalakshmi, learned counsel for respondent No.2. 2.

Seeking the Court to quash the proceedings that are pending against the petitioners, who are arrayed as Accused Nos.1 and 2 in S.C.No.43 of 2018 on the file of the Court of Special Judge for SCs and STs (Prevention of Atrocities) Act-cum-Additional District Judge, Nalgonda, the present Criminal Petition is filed.

Learned counsel for the petitioners as well as learned counsel for respondent No.2 submits that the matter is amicably settled between the parties and indeed basing on a trivial issue, a complaint is given to police. Learned counsel for respondent No.2 also submits that none were abused in the name of the caste and thus, the proceedings

are liable to be quashed, basing on the compromise arrived at.

Learned Additional Public Prosecutor did not raise any objection whatsoever to quash the proceedings. 5.

Further, the report of the High Court Legal Services Committee is on record regarding the identification of parties.

Therefore, considering the nature of the case and basing on the submission of the respective parties, this Court is of the view that no purpose would be served even if the proceedings are allowed to be continued. Therefore, this Court considers desirable to quash the proceedings. 7.

Resultantly, the criminal petition is allowed. The proceedings that are pending against the petitioners who are arrayed as accused Nos.1 and 2 in S.C.No.43 of 2018 on the file of the Court of Special Judge for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Nalgonda, are hereby quashed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
