HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.30376 of 2016 Order:

This Writ Petition is filed challenging the action of the fourth respondent in imposing the punishment of withholding of annual increment of the petitioner for a period of one year with cumulative effect by proceedings No.01/467(09)/2015-KVR, dated 26.05.2016. 2.

Learned counsel for the petitioner submits that the punishment was imposed without furnishing the copy of enquiry report. However, since there is a remedy of appeal against the impugned order, this Court is not inclined to consider the said aspect, but gives liberty to the petitioner to raise this point in the appeal to be preferred against the impugned order. The petitioner is given two weeks time for preferring the appeal against the impugned order before the competent authority and, as and when the appeal is preferred, the competent authority shall consider the same and pass appropriate orders in accordance with law within a period of three

(3) months from the date of filing the appeal. 3.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
