HCJ & AAR, J C.C. No.1413 of 2019 Dt: 22.01.2020 ORDER: (per the Hon'ble Sri Justice A. Abhishek Reddy) This Contempt Case is filed alleging wilful disobedience of order, dated 03.04.2018, passed by a learned Coordinate Bench of this Court in W.P (P.I.L) No.80 of 2018. By the said order, the learned Coordinate Bench has passed the following order:

"Pending further orders, the official respondents shal1 ensure that no further construction is made by the unofficial respondents on the subject land. The unofficial respondents shall not alienate or create any third party rights over the subject land. It is made clear that the order now passed by us shal1 not disable the official respondents from taking action, against the unofficial respondents, in accordance with the provisions of the A.P. Assigned Lands (Prohibition of Transfers) Act and the Rules made thereunder." The third respondent has filed a counter stating that Sy.No.213 consists of Ac.77.10 guntas of land, out of which, Ac.26.33 guntas of land was assigned to landless poor persons, and in the remaining land, the official respondents have erected boards stating that it is a Government land. Insofar as the constructions made by the unofficial respondents are concerned, it is stated that they have removed the same, and in proof of the said removal, they have filed photographs.

In view of the fact that the official respondents have removed the constructions made by the unofficial respondents, the Contempt Case is closed. However, the official respondents are directed to see that no unauthorized

HCJ & AAR, J C.C. No.1413 of 2019 Dt: 22.01.2020 construction or encroachment takes place in the subject land. There shall be no order as to costs.

As a sequel, miscellaneous petitions, pending if any, shall also stand closed.
