THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.S.K. JAI SWAL L.A.A.S.No.473 of 2016 JUDGMENT: (Per Hon'ble Sri Justice Sanjay Kumar) Sri K. Rathanga Pani Reddy, learned counsel for the appellant, informs this Court that L.A.A.S.No.146 of 2016 arising out of L.A.O.P.No.8 of 2001 on the file of the learned Principal Senior Civil Judge, Nandyal, in relation to the very same acquisition was allowed in part by a Division Bench of this Court vide judgment dated 11.07.2016. A copy of the said judgment is placed on record and the learned counsel would submit that the issues arising in this appeal are squarely covered thereby. Learned Government Pleader for Appeals would concede that the matter is covered but in the light of the delay in the presentation of this appeal, he would state that the concluding paragraph of the judgment relied upon may also be reiterated.

In that view of the matter, the appeal is allowed in part for reasons alike as were mentioned in the aforestated judgment and in terms thereof, enhancing the compensation for the acquired land from Rs.50,000/- per acre to Rs.1,50,000/- per acre. The appellant is also entitled to statutory benefits. However, he would not be entitled to interest on the enhanced compensation from the date of the judgment of the Reference Court to this date owing to the delay in the presentation of this appeal.
