HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26099 of 2015 ORDER:

The petitioner is the wife of the deceased employee, S.Krishna, who was working as a Valve Operator in Civil Engineering Department, Kothagudem area. He died on 21.04.1995. When the petitioner came to know that the respondent company rules provide for appointment on compassionate grounds to the children of the deceased employees, she submitted an application to the respondents. Initially, there was a dispute with regard to the nature of death of the husband of the petitioner and when an order was passed by the Commissioner for Workmen's Compensation, Khammam, in W.C.No.28 of 2001, an appeal was filed in C.M.A.No.328 of 2005. The said appeal was dismissed by this Court on 26.06.2015. In view of the dismissal of the appeal, the nature of death of the petitioner's husband is established. In those circumstances, she submitted a representation on 02.01.2015 to the 2nd respondent seeking employment to her son and when the same was not disposed of, the present writ petition was filed.

During the last one year, despite granting three adjournments, the respondents could not file counter-affidavit.

In the circumstances, the Writ Petition is disposed of directing the 2nd respondent to consider the representation of the petitioner dated 02.01.2015 and pass appropriate orders thereon in accordance with law within a period of three months from the date of receipt of a copy of this order. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
