ORDER:
Feeling aggrieved by the inaction of respondent Nos.1 to 3 and 5 in taking action against respondent No.4, the present writ petition is filed by the President of the Mandal Praja Parishad, Ponduru Mandal, Srikakulam District.
At the hearing, learned Assistant Government Pleader for Panchayat Raj Institutions (AP) on instructions submitted that after receiving the enquiry report, respondent No.3 has served a Charge Memo dt.18.11.2015 on respondent No.4 through respondent No.5 on 19.11.2015 and that further action will be taken on receipt of the explanation of respondent No.4.
From the dates given by the learned Assistant Government Pleader as noted above, it is evident that exactly two months had elapsed from the date of service of Charge Memo on respondent No.4. The learned Assistant Government Pleader is unable to state whether respondent No.4 has filed explanation to the Charge Memo or not. Respondent No.3 is therefore directed to expedite the disciplinary action and pass a final order after following due process of law, within two months from the date of receipt of this order.
Subject to the above directions, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.46494 of 2015 shall stand disposed of as infructuous.
