THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7900 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Sole accused seeking bail in the event of his arrest in connection with Crime No.307 of 2023 dated 25.07.2023 on the file of Station House Officer, Jagitial town Police Station, Jagitial District registered for the offences punishable under Sections 341, 290, 307, 384 and 506 of the Indian Penal Code (for short "IPC").

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The de facto complainant filed a written complaint on 25.07.2023 alleging that he was a journalist by profession. This petitioner was insulting the de facto complainant and other journalists and their profession. He made comments in Social Media and also on

Whatsapp group. The de facto complainant called the petitioner on phone and threatened him with dire consequences. On 25.07.2023 while he was going by walk at RDO Chowrasta, petitioner came on his motor cycle, obstructed him on the middle of the road and abused in filthy language and attempted to kill him with a knife. An amount of Rs.5,000/- was snatched from the de facto complainant. Thereafter, he fled.

The learned Public Prosecutor on instructions would submit that no injuries were received by the de facto complainant. As seen from the complaint, there are differences between the petitioner and the de facto complainant. In the said circumstances this Court deems it appropriate to order as follows:-

1) The petitioner/sole accused is directed to surrender before the Station House Officer, Jagitial town Police Station, Jagitial District on 31.08.2023. Upon such surrender, the said Station House Officer shall release the petitioner/sole accused on bail, on his

executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/sole accused shall appear before the concerned police every day for a eight weeks at 10.00 a.m. as and when required for the purpose of investigation .

3) The petitioner/sole accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 5.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
