THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8436 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Mandamus declaring the inaction of the respondents i.e. completing the construction of balance CC pavement from Km 5.967 to Km 6.000 (Pekeru Village Limits Irgavaram Mandal, West Godavari District) under the special repairs to Yerraicheruvu - P Vemavaram road even though a confirmed tender was awarded to the contractor on 05.12.2015, is illegal, arbitrary and violation of Article 14, 19 and 21 of the Constitution of Indian and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of Justice."
It appears that the petitioner made representation dated 06.02.2016 seeking completion of the pavement construction. Despite the same, no steps have been taken by the Executive Engineer, Roads and Buildings Department, Andhra Pradesh. As it is not open to the State authorities to delay the completion of public works causing inconvenience to the citizens, the writ petition is disposed of directing the State authorities concerned to immediately act upon the petitioner's representation dated 06.02.2016 and undertake the construction of the balance pavement works. This exercise shall be completed expeditiously and in any event, not later than six weeks from the date of receipt of a copy of this order.
