THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 28555 of 2017 ORDER:
The petitioner was appointed as a dealer of fair price shop No.3384221, situated at Door No.1-91/1, Jeedimetla, Quthbullapur Mandal, Medchal Malkajgiri District.
The authorization was valid up to 31.03.2017, but the petitioner paid the challan for renewal of authorization on 22.03.2017. As a result of such payment within the period of expiry of the original authorization, the petitioner was allowed to continue. While so, the shop was inspected on 05.08.2017 and it appears that certain irregularities were noticed, but no show cause notice was issued to the petitioner till today. In those circumstances, when the petitioner was not permitted to distribute the essential commodities to the ration card holders, he filed the present writ petition.
This Court adjourned the case thrice in order to ascertain whether any action was taken against the petitioner. Learned Government Pleader for Civil Supplies received written instructions stating that the fair price shop was inspected on 05.08.2017, but nothing was stated with regard to any pending action against the petitioner.
In the absence of any order by the competent authority, the petitioner shall not be prevented from continuing supply of essential commodities.
In these circumstances, the writ petition is allowed directing respondent No.3 to continue the petitioner as fair price shop dealer so long as his authorization is valid and no adverse order is passed against his continuation.
Miscellaneous petitions, if any, pending in this writ petition shall also stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:04.09.2017 kdl
