THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5508 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners/A.7 and A.8 seeking grant of anticipatory bail in connection with crime No.132 of 2015 on the file of the Shameerpet Police Station, Cyberabad District, registered for the offences under Sections 120B, 419, 420, 468, 471 read with Section 34 IPC.

Heard and perused the records.

The learned counsel for the petitioner submits that the first petitioner/A.7 is only witness to the document and as such, he has not involved in any of the offence and as such, he may be granted anticipatory bail. He further submits that the second petitioner/A.8 is the purchaser of the property without knowledge of title of the vendor and as such, he may also be granted anticipatory bail. He further submits that the petitioners are ready to cooperate with the investigating agency and they are ready to comply with any of the conditions that may be imposed on them while granting anticipatory bail.

Having regard to the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the first petitioner herein/A.7 only and this Court is not inclined to grant anticipatory bail to the second petitioner herein/A.8 as this Court is of the view that knowing fully well that the entire transactions are based on forged documents, he purchased the property and he, on the premise of purchase of the property, has filed a suit before the trial Court. In the circumstances, the first petitioner/A.7 is directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, he shall be enlarged on bail on the same day on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Magistrate. Further, the first petitioner/A.7 is directed to report

before the Station House Officer concerned, daily between 10.00 a.m., and 5.00 p.m., until further orders.

Insofar the second petitioner/A.8 is concerned, this Court is not inclined to grant anticipatory bail.
