HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.25367 of 2004 ORDER :

When the matter is taken up for hearing, it is noticed that the petitioner is challenging the reference made by respondent No.3 - Government to respondent No.1 - Industrial Tribunalcum-Labour Court in favour of respondent No.2 - Union. However, a perusal of the docket sheet reveals that the writ petition as against respondent No.2 is dismissed for default for non-compliance of the order dt.30.12.2010 and the petitioner has not taken any steps to restore the writ petition as against respondent No.2. In the absence of respondent No.2, who is a proper and necessary party, this Court cannot adjudicate the writ petition on merits.

Accordingly, this Writ Petition is dismissed. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
