THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 14199 of 2015 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as a Fair Price Shop Dealer of Shop No.18 of Thollaganganapalle Village, Valluru Mandal, YSR Kadapa District. While so, the Mandal Revenue Inspector, along with Village Revenue Officer, inspected the shop on 11.03.2015, and found variations in distribution of stock. However, a show cause notice was issued by the 2nd respondent on 10.04.2015 levelling certain charges against the petitioner and the petitioner submitted his explanation. Having not satisfied with the explanation submitted by the petitioner, the 2nd respondent issued proceedings on 20.04.2015 suspending the authorization of the petitioner pending enquiry. Challenging the same, the present writ petition is filed.

This Court, by an order dated 07.05.2015, granted interim suspension of the said proceedings and the said order is continuing till today. Now a counter affidavit is filed on behalf of the respondents justifying the order of suspension. But this Court is not inclined to go into the merits of the case, since a regular enquiry is pending before the 2nd respondent in respect of the allegations levelled against the petitioner. In the circumstances, the 2nd respondent shall complete the enquiry, giving due opportunity to the petitioner and complete the same, within a period of three months from the date of receipt of a copy of the order and the order of suspension granted by this Court on 07.05.2015 shall continue till conclusion of the enquiry and passing of a final order by the 2nd respondent.

The Writ Petition is, accordingly, disposed of.
