THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7936 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos. 2 & 3 in Crime.No.469 of 2023 on the file of Mailardevpally Police Station, Cyberabad District, registered for the offences under Sections 498-A and 304-B of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record. 3.
The deceased who is the wife of A-1 committed suicide by hanging herself on 05.07.2023. There was an altercation on 04.07.2023 according to the remand report.

Admittedly, the petitioners were living along with the deceased and A-1. However, there are no specific
allegations against these petitioners as to how they are responsible in abetting suicide.

Keeping in view that the petitioners are aged about 58 and 60 years respectively and they are in jail since 12.07.2023, this Court deems it appropriate to grant the relief of regular bail to the petitioners, subject to following conditions:
i) The petitioners/Accused Nos.2 & 3 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of XII Metropolitan Magistrate, Rajendranagar, R.R.District.
ii) The petitioners/Accused Nos.2 & 3 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks and thereafter, as and when required for the purpose of investigation. iii) The petitioners/Accused Nos.2 & 3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
