THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20853 OF 2009 ORDER:
The present Writ Petition is filed seeking issuance of writ of mandamus declaring the Order, dated 27.06.2008 passed by the 1st respondent in proceedings No.E/SV/919/2008, whereby the Stamp Vendor's licence bearing No.2/1976 given in favour of the petitioner was suspended, and also declaring the action of the 2nd respondent in not disposing the appeal filed against the Order, dated 27.06.2008 passed by the 1st respondent as illegal and arbitrary.
2. It is stated that against the order of cancellation the petitioner herein has preferred an appeal.
3. On 24.09.2009 while issuing Rule Nisi, this Court directed the 2nd respondent to dispose of the appeal purported to have been filed by the petitioner being aggrieved by the order dated 27.06.2008 passed by the District Registrar of Assurances, Warangal and pass appropriate orders as per law within a period of four weeks from the date of receipt of copy of this order. If the appeal is not disposed of by that time, the impugned order dated 27.06.2008 vide proceedings No.E/SV/919/2008 of the 1st respondent shall stand suspended.
4. At the time when the matter is taken up for hearing, learned Government Pleader for Revenue has placed on record the proceedings, dated 28.10.2009, whereby the Appeal No.1 of 2009 filed by the petitioner was dismissed.
5. In view of the dismissal of the appeal filed by the petitioner herein, nothing survives for consideration in this writ petition.
6. Accordingly, the Writ Petition is dismissed giving liberty to the petitioner to avail the remedies, if any, available under law. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
