HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10519 of 2015 ORDER:

. The petitioner applied for the post of Technical Assistant/Apprentice pursuant to the notification dated 02.01.2013. He was appointed and posted at Tripuranthakam Mandal on 16.04.2013.

He also participated in the Induction Training for the Trainee Technical Assistants on MG NREGS during the period from 02.04.2013 to 09.04.2013. As per the notification, the candidate should possess Diploma in Civil Engineering or Diploma in Agriculture or Diploma in Horticulture or B.Sc (M.P.C.) or B.Sc (Sericulture). He states that he possessed the said qualification. While so, a show cause notice was issued to the petitioner on 05.03.2015 as to the certificate produced by him at the time of appointment. The petitioner submitted his explanation on 16.03.2015. When final orders were passed on 30.03.2015 terminating the services of the petitioner, the present writ petition was filed.

2. The charge against the petitioner is that he produced a fake qualification certificate (Out of Andhra Pradesh Certificates) at the time of appointment. The petitioner submitted his explanation stating that his uncle has gone to Himachal Pradesh for some contract works and he also accompanied his uncle and obtained a

Diploma in Civil Course from Manav Bharathi University, Solan, Himachal Pradesh.

The 2nd respondent considered the said explanation and noticed that the diploma obtained by the petitioner is not from the University within the State of Andhra Pradesh and hence the services of the petitioner were terminated.

A perusal of the notification shows that the candidate who applies to the post pursuant to the notification shall study regular course from any recognized college under the universities in Andhra Pradesh recognized by the University Grants Commission of India. Since the petitioner did not study the diploma course from any of the colleges affiliated to the Universities in Andhra Pradesh, the termination of services of the petitioner is valid and the writ petition is liable to be dismissed.

4. The Writ Petition is accordingly dismissed. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
