HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.5617 OF 2017 ORDER:
The writ petition is filed challenging the action of the respondents in trying to demolishing the building constructed by the petitioner in an extent of 278.59 sq. yards in R.S.No.175/2, Enikepadu Village, Vijayawada Rural and Mandal, Krishna District. Noticing the deviations made by the petitioner in making the construction, the 2nd respondent authority had issued the notice invoking the provisions under Sections 115 and 116 of the C.R.D.A Act, 2014 (for short, "the Act"). Petitioner has got ample opportunity to submit his explanation to the impugned notice. Instead of submitting the explanation, petitioner has approached this Court.
In those circumstances, the writ petition is disposed of giving liberty to the petitioner to avail the opportunity of submitting his explanation within a period of period of ten days from the date of receipt of copy of this order and thereafter receiving the said explanation, the respondents shall pass appropriate orders in accordance with law, within a period of two weeks. Till then, the respondent-authorities shall not take any coercive steps towards demolition of the building of the petitioner. With the above observations, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any pending in this writ petition shall stand closed.
