Dhandyala Ravi Kumar, v. The Government Of Telangana,
THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.18118 of 2014 ORDER:
There is no representation on behalf of the petitioner. 2.
The prayer sought in the writ petition is as under:- "...to issue, a writ of Mandamus declare the in action of the Respondent No.3 and 4 in not executing the Non Bailable Warrants issued by the learned 2nd Addl. Judicial First Class Magistrate Khammam vide C.C.No.41 of 2010 against the Respondent Nos.5 & 6 as illegal, arbitrary, and violative of Art 14 and 21 of Constitution of India and contrary to law and to direct Respondent Nos.3 & 4 to execute the Non Bailable Warrants against the Respondent Nos.5 & 6 pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
3.
Learned Government Pleader appearing for respondent Nos.1 to 4 placed on record a letter, dated 08.12.2019, issued by the Sub-Inspector of Police, Khammam Rural Police Station. 4.
From a perusal of the said letter, it is revealed that the II Additional Junior Civil Judge passed an order, dated 17.11.2017, which reads as follows:
"Complainant present. Complainant filed petition U/Sec.257 of Cr.P.C. by stating that both parties have been entered into compromise on the intervention of the elders, and the matter was settled amicably to maintain the good relation and to avoid future litigations and there are no claims or disputes against each other and intended to withdraw the complaint against the accused. Hence the case is dismissed as withdrawn U/Sec.257 Cr.P.C." 5.
In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be dismissed.
6.
Accordingly, the writ petition is dismissed. No order as to costs.
Miscellaneous petitions pending, if any, shall stand dismissed. ___________________ P. KESHAVA RAO, J 9th December 2019 mar
