Heard Mr.Raja Gopallavan Tayi for petitioner and learned Assistant Government Pleader (Revenue) for respondents. The petitioner prays for the following relief: "....this Hon'ble Court may be pleased to issue an appropriate writ, order or direction, more particularly a Writ in the nature of Mandamus declaring the action of the respondents in constructing the Government Degree College in the land which is not allocated for construction of Government Degree College in Kodangal Village, Vikarabad District, as illegal, arbitrary and unconstitutional and consequently direct the respondents to construct the Government Degree College at the site allocated of Kodangal Village, Vikarabad District, and be pleased to pass....... "
The complaint of petitioner is based on panchanama dated 28.06.2010 and the construction now undertaken by respondents is identified to the land allotted through panchanama dated 28.06.2010. The petitioner filed photographs as Annexure P-5. Written instructions dated 20.06.2017 and the location sketch are taken on file.
In short, the complaint of petitioner is that the construction of Government Degree College is undertaken not at the place allotted to Government Degree College, but is at a far off place. For the said purpose, the petitioner relies upon the photographs. This Court has difficulty in examining each one of the aspects now complained by petitioner with reference to sketchy details, either on allotment of land for construction of Government Degree
College or construction of Government Degree College at a place other than the allotted place. The fact that the foundation stone was laid slightly away from the ongoing construction site by itself cannot be treated as construction is not at the place where land is allotted for construction of Government Degree College.
According to respondent No.3, the construction of college is undertaken in an extent of five acres granted to them through proceedings dated 28.06.2010.
The statement is placed on record and the writ petition is dismissed. There shall be no order as to costs. Consequently, pending miscellaneous petitions, if any, stand closed.
