HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7394 OF 2003 ORDER (ORAL):

When the Writ Petition is taken up for hearing, it is contended by the learned counsel for the petitioner Sri K. Ananda Rao that the petitioner was appointed as driver under the respondents in March, 1987, on NMR (Nominal Muster Roll) basis. The petitioner has filed the present writ petition challenging the action of the respondents in not considering his case for regularization.

2. The learned counsel for the petitioner further submitting that the respondents vide their proceedings dated 31.03.1998 had even recommended the case of the petitioner for regularisation of his services to the Government as per G.O. Ms. No.212 dated 22.12.1994, contends that the writ petition should be allowed directing the respondents to regularize the services of the petitioner.

3. The learned standing counsel appearing for the respondents had contended that the petitioner is not working as on today and he has been retrenched on 02.07.2003 itself and he was paid retrenchment compensation as well, and, therefore, the relief sought for by him cannot be granted now.

4. Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that since the petitioner has been retrenched and he has received retrenchment

AKS,J WP No.7394 of 2003 compensation also, the relief sought for by him cannot be granted now. Thus, there are no merits to entertain this writ petition.

5. Therefore, the Writ Petition is dismissed. There shall be no order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition stand closed.
