Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.1 of Kanimetta Village, Kothakota Mandal, Mahabubnagar District. While so, basing on the report of the third respondent, the second respondent issued a show cause notice dated 09.03.2015 to the petitioner. The petitioner submitted his explanation on 13.03.2015. The second respondent passed the impugned order dated 25.03.2015 stating that no explanation is submitted by the petitioner. Challenging the same, the present Writ Petition is filed.

3. This Court perused the order dated 25.03.2015 and it is clear from the order that the report of the third respondent was taken into consideration and the authorization of the petitioner was accordingly cancelled. A perusal of the order does not indicate conduct of enquiry.

4. In the circumstances, the impugned order dated 25.03.2015 of the second respondent, is set aside and the Writ Petition is allowed. However, this will not prevent the second respondent from conducting an enquiry in respect of the allegations against the petitioner in accordance with law, if he so chooses. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
