HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE MS. JUSTICE J. UMA DEVI Writ Petition No.5123 of 2017 ORDER: (per Hon'ble Sri Just ice V. Ramasubramanian) Heard Mrs. P. Vijaya Lakshmi, learned counsel for the petitioner. Sri S. Suri Babu, learned special standing counsel takes notice for the respondents.

2. The dispute which led to the officials at the check post of the Commercial Tax Department detaining granite slabs carried by the petitioner was that the quantity of goods carried was more than the quantity reflected in the way bill. The petitioner claims that they did not carry anything more than the quantity reflected in the way bill. If the petitioner has carried only as much quantity as mentioned in the way bill, they should be allowed to take the goods right royally. If there is more than the quantity of goods than what is reflected in the way bill, this petitioner as an honest dealer cannot lay any claim upon the balance.

3. Therefore, the writ petition is disposed of directing the respondents to release as much quantity of material as indicated in the way bill. If the quantity carried is more than what is reflected in the way bill, the respondents may detain the same in accordance with law. There shall be no order as to costs.
