THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7951 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 seeking bail in connection with Crime No.341 of 2023 dated 28.05.2023 on the file of AJ Mills Colony Police Station, Warangal District registered for the offences punishable under Sections 420, 312, 313, 315 read with Section 34 of Indian Penal Code (for short "IPC").

Heard learned counsel for the petitioner/Accused No.2 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that Accused No.1/doctor and Accused No.3 were running a clinic and involved in sex determination test and thereafter, getting pregnant woman aborted. In the present case, the victim

alleged in the complaint stating that she went to accused No.1 with the help of this petitioner/Accused No.2 and there she was aborted without her consent.

Even according to the Remand C.D this petitioner/Accused No.2 was acting as an agent in between the patient and doctor/Accused No.1. Accused No.1 who had performed abortion was granted bail. 5.

Keeping in view that the petitioner was arrested on 30.05.2023 and the investigation is almost completed, this Court deems it appropriate to enlarge the petitioner on bail subject to the following conditions:

i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of I Addtional District and Sessions Judge, Warangal.

ii) The petitioner/Accused No.2, after release shall appear before the concerned Station House Officer on every day at 10.00 a.m., for a period of

three weeks from the date of this order. It is needless to say, he shall appear before the concerned Court for the purpose of completion of trial.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
