1. This Criminal Petition is filed by the petitioner-Accused No.2 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.5 of 2016 on the file of Isvi Police Station, Kurnool District, registered for the offence punishable under Sections 406, 420 r/w 34 IPC and 9-1 APGA (Matka) Act.

2. Heard and perused the material available on record.

3. From the material available on record, it is apparent that earlier, the petitioner was accused in 18 cases and even though, he was acquitted in those cases, this Court is of the view that mere acquittal of the accused itself cannot be a ground to grant anticipatory bail when it is shown that the petitioner was involved in similar crimes earlier.
