This petition is filed, by the petitioners, who are A2 to A6, seeking for quash of the proceedings against them in PRC No.7 of 2011 on the file of the Court of III Metropolitan Magistrate, Cyberabad at L.B.Nagar, R.R.District. The offences alleged against the petitioners are under Section 498-A and 306 IPC.

Heard the counsel for the petitioners and the Public Prosecutor, appearing for the 2nd respondent. None appears for the 1st respondent in spite of notice.

The counsel for the petitioners draws the attention of this court to the suicide note of the deceased, which shows that something uttered by the daughter of the deceased lead to the commission of suicide by the deceased. However, the deceased did not say anything against any of the petitioners, in the suicide note. It appears that because of the words uttered by the daughter of the deceased, the relationship between herself and her husband got affected. However, no such assertion was made by the deceased against the petitioners, which lead to the commission of suicide. She only makes a complaint about her daughter and none else.

Hence, in the absence of any specific allegations against the petitioners, this court opines that continuation of further
proceedings absent the petitioners would only result in abuse of process of law.

With the above observations, the Criminal Petition is allowed and the further proceedings against the petitioners in PRC No.7 of 2011 on the file of the Court of III Metropolitan Magistrate, Cyberabad at L.B.Nagar, R.R.District, are hereby quashed.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
