THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.9055 of 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) Learned Standing Counsel for the Greater Hyderabad Municipal Corporation submits that his client does not want to file counter-affidavit and the writ petition may be disposed of on the basis of the material supplied therein.

By this writ petition, the petitioner challenged the demand notice, dated 07.01.2015. It is stated in the writ petition that without deciding the issue in terms of the direction of the learned Judge of the City Small Causes Court, Hyderabad, in M.A.No.316 of 2013, the respondents have issued the demand notice. Therefore, we set aside the demand notice and direct the respondents to decide the matter in terms of the order of the learned Judge of the City Small Causes Court, Hyderabad, dated 07.09.2013, in M.A.No.316 of 2013, after issuing notice of personal hearing to the petitioner. This exercise must be completed within eight (8) weeks from the date of communication of this order. The writ petition is accordingly allowed.

Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
