THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40057 of 2016

ORDER

This writ petition is filed seeking to declare the action of 2nd respondent in calling upon the petitioners to the police station and making them to sit in the police station by threatening to disburse the amounts credited to the Pearls Agrotech Corporation Limited, as illegal and arbitrary and consequently direct the 2nd respondent not to interfere with the personal life and liberty of petitioners.

Heard both sides and perused the material on record. 3.

The main grievance of petitioners is that though the matter is seized by the Honourable Supreme Court having constituted a Committee for ascertainment of properties to disburse the amount to creditors and the first petitioner also appraised the situation to the police, the 2nd respondent is calling upon them to the police station and threatening them to pay the amounts to the creditors.

Considering the facts and circumstances of the case, I deem it appropriate to direct the 2nd respondent not to interfere with the affairs of petitioners, except with regard to investigation in any case registered against them.

With the above direction, the writ petition is disposed of. No costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand dismissed.
