THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18104 of 2016 ORDER:
In this writ petition, petitioner challenges the show cause notice dated 02.07.2015 issued by the 3rd respondent vide proceedings No.B1/2902/2015 and B1/2421/2015.
The grievance of the petitioner is that the show cause notice has been issued alleging certain violations under the Control Order for which the petitioner had submitted her explanation, however, neither enquiry was conducted nor orders have been passed. It is the further case of the petitioner that in spite of the fact that her authorization is neither suspended nor cancelled, she was not being issued with essential commodities for distribution to cardholders. When the matter was listed on 09.06.2016, learned Government Pleader sought time for getting instructions. Hence, the matter was adjourned to today. Even today also, learned Government Pleader is unable to place on record any material to rebut contention that authorization is neither suspended nor cancelled.
In these circumstances, the respondent authorities are directed to issue PDS commodities to the petitioner, for distribution to cardholders, subject to the condition that petitioner's authorization is neither suspended nor cancelled. However, this order shall not be considered as restraining the respondent authorities from conducting enquiry and passing orders in accordance with law, pursuant to the show cause notice already issued.
With above observations, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall
also stand closed.
