Heard Mr Tata Singaiah Goud, N.M.Krishnaiah for petitioners, M.V.Suryanarayana for unofficial respondents and Assistant Government Pleader for Home.
These two writ petitions are filed for the relief against alleged interference by respondent Nos.2 and 3, as illegal, arbitrary and unconstitutional.
The petitioners in the respective affidavits complain that the police are interfering in civil disputes and such interference is impermissible under law.
The contesting respondents i.e., 5 to 7 (W.P.No.22163 of 2015) filed counter affidavit together with Annexures and tried to convince this Court that remedy under Article 226 is abused by petitioners and the underlying idea in filing these writ petitions is to exert pressure on police. The Assistant Government Pleader (Home) basing on written instructions dated 08.11.2017 submits that the SHO, Vidavaluru P.S. registered Crime Nos.126/2014, 22 of 2015 and 52 of 2015 and had investigated the alleged offences strictly in accordance with Code of Criminal Procedure. He further states that the inter se civil disputes
between petitioners and respondent Nos.5 to 7 are seized by the Civil Court.
From the above, it is clear that on apprehensions this Court is called upon to adjudicate, which this Court is not prepared to undertake in the present scenario. As police are saying that they are not interfering in civil disputes, no further order is necessary. At the same time, this observation ought not to be understood as this Court restricted the power of police to undertake investigation to pending crimes or unofficial respondents to work out their rights in pending suits.
Both the writ petitions are accordingly disposed of. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
