THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12269 of 2002 ORDER:

This Writ petition is filed seeking to issue a writ of Certiorari calling for the records connected with I.D.No.207 of 1999 on the file of the Industrial Tribunal-cum-Labour Court, Visakhapatnam, issued in G.O.Ms.No.156 Labour Employment Training and Factories (Lab-I) Department, dated21.1.2002 and quash the award dated 5.1.2002 passed therein as illegal and arbitrary. A consequential direction is also sought to reinstate the petitioner into service as Watchman with all consequential benefits.

Heard Sri M.V.S.Sai Kumar, learned counsel for the petitioner and the learned Government Pleader for Labour. It has been contended by the petitioner that he was initially appointed as watchman in the 1st respondent-School. While he was discharging his duties, he was terminated from service vide proceedings dated 31.8.1999 of the 1st respondent. Challenging the same, the petitioner had filed I.D.No.207 of 1999 on the file of the Industrial Tribunal-cum-Labour Court, Visakhapatnam. The Industrial Tribunal vide orders dated 5.1.2002 dismissed the case. Questioning the same, the present writ petition is filed. Learned counsel for the petitioner contended that without appreciating the contents therein, the Industrial Tribunal had mechanically passed the order dismissing the case .

Considering the submissions made by both the parties, this Court is of the opinion that no irregularity or illegality has been pointed out in the orders passed by the Industrial Tribunal-cumLabour Court. Therefore, there are no merits in the writ petition. Accordingly, the Writ Petition is dismissed. No order as to costs.
