Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner was appointed as fair price shop dealer of shop No.4 of Appalarajupuram village, Cheedikada Mandal, Visakhapatnam District. The authorization of the petitioner is valid upto 31.03.2016. While so, on 28.01.2015, the Assistant Supply Officer, Anakapalli Division inspected the shop of the petitioner and found some variation in the stock and he submitted a report. Based on which, 6A proceedings were initiated against the petitioner and they are pending. While so, the 3rd respondent passed an order on 16.03.2015 suspending the authorization of the petitioner temporarily. Challenging the said order, the present writ petition is filed. The learned counsel for the petitioner submits that the order does not speak of any enquiry and no show cause notice was issued to the petitioner.
On those grounds, he submits that the order of the 3rd respondent should be set aside. But, I am not impressed with the said argument of the learned counsel for the petitioner. The order speaks of temporary suspension. When the authorization of the petitioner was temporarily suspended, the 3rd respondent ought to have issued a show cause notice, but no show cause notice appears to have been issued to the petitioner.
can as well pass order revoking the order of suspension. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
