THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6118 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.1 to 4 in Crime No.103 of 2022 on the file of Station House Officer, Bhadrachalam Town Police Station, Bhadradri-Kothagudem District registered for the offence punishable under Section 8(c) read with Section 20(b) of NDPS Act.

Heard learned counsel for the petitioners/Accused Nos.1 to 4 and the learned Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that the petitioners were apprehended by the Bhadrachalam Town Police with two bags of ganja in one Auto and one motor cycle and found 32 kgs of ganja in their possession. Two petitioners were travelling on the motor cycle and two others in auto.

Learned counsel for the petitioners submits that the investigation is complete, which is not disputed by the learned Assistant Public Prosecutor.

In the said circumstances, when two bags are seized from one auto and one motor cycle, these petitioners can be granted the relief of bail for the reason of completion of investigation. 6.
Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.1 to 4 are granted bail subject to the following conditions:
i) The petitioners/Accused Nos.1 to 4 shall execute personal bonds for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for a like sum each among which one local and one native surety to the satisfaction of Special Sessions Judge for the Trial of Cases under Narcotic Drugs and Psychotropic Substances Act - cum - I Additional Sessions Judge at Khammam. ii) The petitioners/Accused Nos.1 to 4 shall appear before the concerned Court on every date of hearing without fail, failing which
the prosecution is at liberty to seek cancellation of bail granted to the petitioners.
iii) The petitioners/Accused Nos.1 to 4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 22.08.2022 ns
