THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.33016 of 2015 ORDER :

The building permission application was submitted by the petitioners in the

name of their deceased mother and father and the same was processed. Having noticed that the building application was submitted in the name of deceased persons, by endorsement dated 14.07.2015, the said application was returned.

2. According to learned counsel for the petitioners it is true that the building permission application was submitted in the name of the parents of the petitioners who are no more. Having realized that it was wrongly made, a representation was submitted on 08.07.2015 to treat the said building application, as if filed by the petitioners and they accordingly, counter signed.

3. Earlier the building application was made in the name of the deceased persons and counter signing of such application by the petitioners does not arise. Therefore, I do not see any illegality in rejection of the building permission application submitted by the petitioners. However, learned counsel for the petitioners submit that the petitioners are willing to submit fresh application.

4. Having regard to the above, it is always open to the petitioners to make fresh application to the 2nd respondent and as and when such application is filed, the same shall be considered by the 2nd respondent, in accordance with Building rules, as expeditiously as possible preferably within a period of four (4) weeks from the date of receipt of such application.

5. With the above observations, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ P.NAVEEN RAO,J 08th October, 2015.
