Heard learned counsel for the appellants and learned counsel for the respondents.

Perused the proceedings dated 24.02.2022. The legal representatives of deceased-first respondent are brought on record in the array of respondents as respondent Nos.5 to 8. Today, compromise petition is filed with the joint memo. As per the terms of compromise, the appellants have deposited a sum of Rs.9,28,194/- i.e. 50% of the compensation amount and that the claimants are willing to settle the entire claim only for Rs.7.00 lakhs. The appellants have agreed to pay the said amount of Rs.7.00 lakhs towards full and final settlement of the claim of the claimant in M.V.O.P.No.744 of 2012. It was further agreed between the parties that the appellants have agreed to deposit the compromise amount by way of cheque and on receipt of copy of the judgment and decree of this Court. It was further agreed that the appellant has to give cheque of Rs.7.00 lakhs to the claimants and the respondents/claimants have agreed to receive the same in terms of the terms towards full and final settlement of their claim in M.V.O.P.No.744 of 2012.

- 2 - Accordingly, the appeal is disposed of modifying the judgment and decree in M.V.O.P.No.744 of 2012 in terms of compromise. No costs.

Pending miscellaneous applications, if any, shall stand closed.
