THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9591 OF 2017 ORDER:
Heard learned counsel for petitioners/A4, A5 and A7 of Crime No.179 of 2016 of Nawabpet Police Station, registered for the offences punishable under Sections 417, 418, 420 r/w 34 IPC, from the police during investigation filed the memo showing them as additional accused, though the said crime registered originally from the report of the defacto complainant only against three accused A1 to A3, who are not before this Court, on 14.11.2016 of the complaint of the 1st respondent - defacto complainant, since the same was filed on 26.09.2016 and forwarded by the learned Judicial First Class Magistrate, Vikarabad, under Section 156(3) Cr.P.C. to the police for investigation.

Having regard to the above, though it is a matter for investigation from the submission of the learned public prosecutor as from the factual matrix there is nothing to arrest the petitioners for purpose of investigation, thereby, there shall be stay of arrest, however, investigation shall go on and it will not prevent the police to secure the presence of the accused for purpose of investigation. 3.
Accordingly and with the above direction, this criminal petition is disposed of.
Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
